These terms govern the use of Barka Go (barkago.app), a platform published by TCH-S SARL. By booking a ticket or using a company's workspace, you accept them.
1. What Barka Go is
Barka Go is an online platform that lets travellers search, book and pay for bus tickets from transport companies, and provides these companies with management software (stations, buses, routes, departures, counter, boarding, cash desk).
TCH-S SARL publishes the platform. It is not a carrier: the transport contract is made directly between the traveller and the company operating the trip.
2. Who does what
The transport company sets its timetables, prices, cancellation and luggage rules. It alone is responsible for the transport, passenger safety and refunds.
Barka Go provides the technical tool: trip listings, booking, electronic ticket, trip information messages.
3. Booking and payment
Chosen seats are held for 10 minutes while you pay. Without a confirmed payment within that time, they are released.
Online payment is made by mobile money (Orange Money, MTN Mobile Money) directly to the company's merchant account. TCH-S SARL never receives or holds the traveller's money.
The ticket is issued only once the mobile money operator has confirmed the payment. The price shown before paying is the full price.
4. Ticket
The ticket carries a signed QR code and a short code. It is personal and valid once, for the departure and seat shown. Show it at boarding, on your phone or printed.
Keep your ticket's secret link private: anyone who has it can display the ticket. If lost, “Find my ticket” gives you a new one using the booking reference and phone number.
5. Delays, cancellations, refunds
Delays and cancellations are announced by the company; Barka Go passes them on by e-mail or WhatsApp when you agreed to it.
Cancellation and refund conditions are the company's. Refunds are made by the company, by the means it chooses.
6. Traveller's commitments
You agree to give accurate information (passenger names, phone number), not to book abusively (repeated seat holds without paying) and not to try to forge a ticket.
7. Companies using Barka Go
A company uses Barka Go under the plan it chooses (free Discovery, or a paid plan invoiced monthly). Plan prices and limits are shown in “My plan”.
A commission on each online sale is due to TCH-S SARL. As the money is collected directly by the company, this commission is added to its monthly invoice. An invoice unpaid at its due date cuts off online sales until payment; the counter keeps working and no data is deleted.
The company is responsible for the merchant account access keys it enters, for its user accounts (passwords, two-factor authentication) and for the accuracy of the trips and prices it publishes.
The company is responsible for its travellers' data; TCH-S SARL processes them on its behalf, as described in the privacy policy. [TO CONFIRM: data processing agreement]
8. Availability and liability
TCH-S SARL does its best to keep the platform available and secure (daily backups, monitoring), without guaranteeing uninterrupted service, in particular during maintenance or network or mobile money operator outages.
TCH-S SARL is not liable for the performance of the transport, nor for indirect losses. [TO CONFIRM: liability cap]
9. Intellectual property
The Barka Go brand, software and platform content belong to TCH-S SARL. Companies' names, logos and content remain theirs.
10. Personal data
How your data is processed is described in the privacy policy.
11. Changes to these terms
These terms may change. The applicable version is the one online at the time of booking; companies are informed by e-mail of any significant change.
12. Governing law and disputes
These terms are governed by Cameroonian law and the OHADA uniform acts, without depriving the traveller of the mandatory protections of their country. Disputes are first settled amicably; failing that, the courts of Douala have jurisdiction. [TO CONFIRM with the lawyer]
